Hi,
I don't think he is Confederate.
He is shown in a group of photos on the LOC of the 22nd New York State Militia at Harpers Ferry, 1862.
Francis Lord - CW Collector's Encyclopedia, pg. 313 - says it is Gilbert J. Marbury, Co. H, 22nd NYSM at Harper's Ferry 1862. Knew I saw him somewhere before.

He's a member of the 22nd NYSM, known as the "Strawberry Grays" because of the red trim on the jackets and caps. You can see a portion of the red band on his cap, and the red facings on his cuffs.
A short google search will locate further images and information.
